Where export or display functionality is provided by MPSIndex, Users may use those outputs within the permissions of their applicable plan.
Manipulating a score, label, date, recipient, provider, or other material part of an MPSIndex Result in a misleading way is prohibited.

Unauthorized scraping, crawling, mass extraction, automated enumeration, or collection of platform data is prohibited.
Reasonable technical limitations, rate limits, authentication requirements, or anti-abuse controls may be applied.
15. APIs
Where API access is available, the User must:
- keep API credentials secure;
- use the API only for authorized purposes;
- comply with technical limits;
- avoid excessive or abusive requests;
- prevent unauthorized access.
API access may be suspended or revoked in case of security risk, misuse, or material violation of these Terms.
16. Third-Party Integrations
MPSIndex may integrate with third-party products and services.
Third-party systems may include payment providers, hosting providers, email delivery providers, website platforms, analytics or infrastructure providers, and other technology services required for operation.
The use of third-party services may also be subject to the provider's own terms and privacy policies.
MPSIndex is not responsible for the independent acts, policies, availability, or security practices of third-party providers beyond obligations imposed by applicable law.
17. WordPress Integration
MPSIndex may provide an official WordPress plugin allowing a User to connect an authorized WordPress website to an MPSIndex Account.
The WordPress connection is initiated explicitly by the User.
The User must authenticate with MPSIndex and approve the specific WordPress website before the connection is established.
The integration may use a site-bound, limited, revocable authorization token.
The WordPress plugin is designed to retrieve and display authorized MPSIndex information.
Unless explicitly stated otherwise, the WordPress integration does not permit the WordPress website to:
- create MPSIndexes;
- modify MPSIndexes;
- delete MPSIndexes;
- publish new MPSIndexes within the User's SaaS Account;
- access the User's email login codes;
- access the User's primary login token.
The User may disconnect the WordPress integration.
Disconnecting a WordPress site does not automatically delete the User's MPSIndex Account or MPSIndex Results.
18. External Service Communication
Certain MPSIndex integrations require communication with MPSIndex servers.
Such communication is necessary to provide the requested SaaS functionality.
Where an integration requires authorization, communication begins through an explicit User action, configuration, registration, authentication, or connection process.
Information transmitted by an integration is limited to what is reasonably required to provide the applicable functionality.
Further information is available in the MPSIndex Privacy Policy and GDPR documentation.
19. No Unauthorized Tracking
MPSIndex does not authorize hidden or deceptive tracking through its integrations.
Data processing associated with the Service is governed by the applicable Privacy Policy and related data protection documentation.
Any optional analytics, marketing, or tracking functionality requiring consent will be handled according to applicable legal requirements.
20. Subscription Plans
MPSIndex may offer free or paid Subscription plans.
Available features, usage levels, limits, export formats, integrations, portfolio functionality, API access, and other capabilities may depend on the selected plan.
Current plan details and prices are displayed through the applicable MPSIndex interface or purchase process.
21. Pricing
Prices may vary by:
- plan;
- currency;
- country;
- applicable taxes;
- billing period;
- promotional conditions.
MPSIndex may change prices for future billing periods.
Where legally required, Users will receive appropriate notice before material Subscription price changes take effect.
22. Payments
Payments may be processed by independent payment service providers.
MPSIndex does not necessarily receive or store full payment card information.
The User is responsible for providing valid billing information and maintaining a valid payment method where required.
23. Taxes
Prices may be displayed as inclusive or exclusive of VAT, sales tax, or other applicable taxes depending on the jurisdiction and transaction.
Taxes may be added where legally required.
The User is responsible for taxes for which the User is legally liable.
24. Subscription Renewal
Where a Subscription is recurring, it may renew automatically according to the billing cycle disclosed during purchase.
The applicable Subscription fee may be charged to the registered payment method unless the Subscription is cancelled before renewal in accordance with the available cancellation process.
25. Cancellation
Users may cancel an active Subscription through the functionality provided by MPSIndex or by contacting MPSIndex where necessary.
Cancellation normally prevents future renewal but does not automatically invalidate access already paid for during the current billing period unless otherwise stated.
Mandatory rights provided by applicable law remain unaffected.
26. Refunds
Refund eligibility depends on:
- applicable law;
- the nature of the Service;
- the payment status;
- the circumstances of the request.
Nothing in these Terms limits mandatory statutory refund or withdrawal rights where such rights apply.
Any discretionary refund provided by MPSIndex does not create an obligation to provide identical refunds in future cases.
27. Consumer Rights
Where a User qualifies as a consumer under applicable law, mandatory consumer protection rights remain fully applicable.
Nothing in these Terms is intended to waive or restrict rights that cannot legally be waived or restricted.
Where these Terms conflict with mandatory consumer law, the mandatory legal provision prevails.
28. Service Communications
MPSIndex may send communications reasonably necessary to operate the Service, including:
- login or verification codes;
- security notifications;
- account notices;
- billing information;
- Subscription notices;
- integration notifications;
- technical notices;
- material service changes.
Operational communications are separate from optional marketing communications.
29. Marketing Communications
Where required by law, marketing communications will only be sent with the appropriate lawful basis or consent.
Users may unsubscribe from optional marketing communications using available unsubscribe mechanisms.
Essential account, security, billing, or legal communications may still be sent.

Unless otherwise stated, MPSIndex and its associated:
- software;
- source code;
- architecture;
- design;
- trademarks;
- logos;
- interfaces;
- visual systems;
- documentation;
- terminology;
- proprietary processes;
are owned by or licensed to the Service Provider.
These Terms do not transfer ownership of MPSIndex intellectual property to Users.
31. User Feedback About the Service
If a User voluntarily provides suggestions, ideas, bug reports, or product feedback about MPSIndex, the Service Provider may use that feedback for product development without an obligation to compensate the User.
This does not transfer ownership of the User's unrelated proprietary business information.
32. Availability of the Service
MPSIndex aims to provide reliable access but does not guarantee uninterrupted availability.
Temporary interruptions may occur because of:
- maintenance;
- updates;
- security measures;
- infrastructure failures;
- third-party service failures;
- internet outages;
- emergency maintenance;
- circumstances outside reasonable control.
33. Changes to the Service
MPSIndex may improve, modify, replace, add, or remove Service functionality.
Changes may be necessary because of:
- technological development;
- security requirements;
- user needs;
- legal obligations;
- commercial changes;
- third-party platform changes.
Where reasonably possible, material changes affecting paid functionality will be communicated appropriately.
34. Beta and Experimental Features
MPSIndex may make beta, preview, experimental, pilot, or early-access features available.
Such features may:
- change;
- contain errors;
- be incomplete;
- be removed;
- operate differently from stable functionality.
Unless otherwise expressly agreed, beta functionality is provided without a guarantee of future availability.
35. Security
MPSIndex applies reasonable technical and organizational measures intended to protect the Service.
Users are also responsible for securing:
- their devices;
- their email accounts;
- login credentials;
- integrations;
- API credentials;
- connected websites.
Users should promptly notify MPSIndex if they become aware of a suspected security incident affecting their Account.
36. Suspension
MPSIndex may temporarily suspend an Account, Subscription, integration, API credential, or specific functionality where reasonably necessary because of:
- suspected fraud;
- security risk;
- unauthorized access;
- payment failure;
- abuse;
- legal requirements;
- material violation of these Terms.
Where appropriate, MPSIndex may provide the User an opportunity to resolve the issue.
37. Termination by the User
Users may stop using the Service at any time.
Account deletion or termination may be requested through available Account functionality or through the published contact channel.
Outstanding contractual or payment obligations remain enforceable where applicable.
38. Termination by MPSIndex
MPSIndex may terminate an Account where:
- the User materially violates these Terms;
- fraudulent activity occurs;
- the Service is abused;
- legal requirements require termination;
- continued operation presents a material security risk;
- outstanding payments remain unresolved;
- the User repeatedly interferes with the platform or other Users.
Termination will be handled consistently with applicable law.
39. Effect of Termination
After termination:
- access to protected Service functionality may cease;
- authorization tokens may be revoked;
- integrations may stop functioning;
- certain data may be deleted according to applicable retention rules;
- legally required records may be retained.
Termination does not automatically remove obligations that by their nature survive termination.
40. Data Export and Deletion
Where supported by the applicable plan or required by law, Users may be able to access, export, or request deletion of eligible data.
Data deletion requests are handled in accordance with applicable data protection law and MPSIndex privacy documentation.
Certain information may need to be retained for legal, accounting, fraud-prevention, or security purposes.
41. Privacy and Data Protection
Personal data is processed according to the separate:
MPSIndex Privacy Policy
and
Global GDPR Compliance Documentation
These documents form part of the framework governing use of the Service.
Users should review them before using MPSIndex.
42. Third-Party Rights
Users must respect copyrights, trademarks, privacy rights, contractual rights, confidential information, and other lawful rights of third parties.
MPSIndex may remove or restrict content where reasonably necessary to address a valid legal claim.
43. No Guarantee of Business Results
MPSIndex does not guarantee:
- increased revenue;
- increased sales;
- more customers;
- improved search rankings;
- successful tenders;
- successful financing;
- successful partnerships;
- improved conversion rates;
- acceptance by financial institutions;
- acceptance by business partners;
- any particular commercial outcome.
Business decisions remain the responsibility of the User.
44. No Professional Advice
Information available through MPSIndex is provided for general business and informational purposes.
It should not be treated as a substitute for professional:
- legal;
- accounting;
- financial;
- tax;
- investment;
- compliance;
- cybersecurity;
- regulatory advice.
Users should obtain professional advice where appropriate.
45. Disclaimer of Warranties
To the maximum extent permitted by applicable law, the Service is provided on an:
“as is” and “as available” basis.
MPSIndex does not guarantee that the Service will always be uninterrupted, error-free, or suitable for every individual business purpose.
Mandatory statutory warranties remain unaffected.
46. Limitation of Liability
To the maximum extent permitted by applicable law, MPSIndex and the Service Provider will not be liable for indirect, incidental, consequential, special, or purely economic losses resulting from use of the Service.
This may include loss of:

Nothing in these Terms excludes liability that cannot lawfully be excluded or limited.
47. User Indemnification
To the extent permitted by applicable law, a User may be responsible for losses or claims resulting from their unlawful use of the Service, intentional misuse, infringement of third-party rights, or material breach of these Terms.
This provision does not apply where liability legally rests with MPSIndex.

- telecommunications failures;
- infrastructure outages;
- widespread cyber incidents;
- labor disputes;

49. Legal and Geographic Restrictions
The Service may be accessible globally, but availability does not mean that use is lawful in every jurisdiction.
Users are responsible for complying with local laws applicable to them.
MPSIndex may restrict access where necessary to comply with sanctions, export controls, regulatory obligations, court orders, or other legal requirements.
50. Assignment
Users may not transfer their Account or contractual rights under these Terms to another party without authorization where such transfer would affect security or contractual obligations.
The Service Provider may transfer these Terms as part of a merger, restructuring, acquisition, sale of business, corporate reorganization, or legal succession, subject to applicable law.
51. No Waiver
Failure by MPSIndex to enforce a provision of these Terms on one occasion does not constitute a permanent waiver of that provision.
52. Severability
If any provision of these Terms is found invalid, unlawful, or unenforceable, the remaining provisions will continue in effect to the maximum extent permitted by law.
Where possible, the invalid provision will be interpreted in a manner closest to its lawful intended purpose.
53. Entire Agreement
These Terms, together with applicable:
- Privacy Policy;

Nothing in this provision deprives a consumer of protections granted by mandatory law in their country of residence where such protections apply.
